Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Adsity mobile and web application (the “Service”) operated by Adsity (“we”, “our”, “us”). By using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old to use the Service. Users between 13 and 18 must have consent from a parent or legal guardian. By creating an account, you represent that you meet these requirements.
2. Account Registration
To use the Service, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations, including but not limited to data protection and anti-spam laws. You agree not to:
- Use the Service to store or transmit content that violates the rights of others
- Send unsolicited messages (spam) through the messaging features
- Attempt to gain unauthorized access to the Service or its systems
- Use the Service to harass, abuse, or harm others
- Reverse-engineer, decompile, or disassemble any part of the Service
- Use automated tools to access the Service except through our published APIs
- Resell or redistribute access to the Service without our written consent
4. Your Data
You retain ownership of all data you enter into the Service, including lead information, sequences, notes, and templates (“Your Data”). You grant us a limited license to store, process, and display Your Data solely to provide the Service to you.
You are responsible for the accuracy and legality of Your Data. You represent that you have the necessary rights and consents to store contact information of the leads you enter into the Service, in compliance with applicable data protection laws.
We handle Your Data as described in our Privacy Policy.
5. Messaging
The Service allows you to compose and open messages in third-party messaging apps (WhatsApp, Telegram, SMS, Messenger). You are solely responsible for the content of messages you send and for complying with all applicable laws, including anti-spam and telecommunications regulations. We do not send messages on your behalf.
6. Facebook Integration
If you choose to connect your Facebook account, you authorize us to access your ad campaign data and leads through the Facebook Marketing API. This access is governed by Meta’s platform terms in addition to these Terms. You may disconnect Facebook at any time from the Settings screen.
7. Multi-Business and Agency Features
The Service supports multi-business accounts and agency management. If you create or manage an agency, you are responsible for ensuring that all members comply with these Terms. Agency owners are responsible for the actions of team members operating within their agency.
8. Availability and Support
We strive to maintain the Service’s availability but do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

9. Intellectual Property
The Service, including its design, code, features, and branding, is owned by Adsity and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.
10. Termination
You may terminate your account at any time by deleting it from the Settings screen in the App (see Account Deletion).
We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. We will make reasonable efforts to notify you before or promptly after any termination.
Upon termination, your right to use the Service ceases immediately and your data will be deleted as described in our Privacy Policy.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADSITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
13. Indemnification
You agree to indemnify and hold harmless Adsity and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if necessary, through binding arbitration or in a court of competent jurisdiction.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
